Affiliate Terms & Conditions

These Affiliate Terms & Conditions (“Terms”) govern participation in the affiliate program (“Program”) operated by Lumivique (“we”, “us”, “our”).
By applying to or participating in the Program, you (“Affiliate”, “you”, “your”) agree to be legally bound by these Terms.

If you do not agree, do not participate in the Program.

1. Affiliate Relationship

1.1 Participation in the Program does not create any employment, partnership, agency, franchise, or joint venture relationship between you and the Lumivique.

1.2 Affiliates act as independent promoters and have no authority to bind, represent, or make claims on behalf of the Lumivique.

2. Eligibility & Approval

2.1 All affiliate applications are subject to review and approval.

2.2 We reserve the right to approve, reject, suspend, or terminate any affiliate account at any time, with or without notice, for any reason, including suspected violation of these Terms.

3. Commission Structure & Earnings

3.1 Affiliates earn commissions only for valid, completed, and verified purchases made by genuine customers using an approved affiliate link or tracking method.

3.2 Commissions are:

  • Performance-based only
  • Earned only when a real acquisition occurs
  • Subject to verification and approval

3.3 Lumivique reserves the right to:

  • Adjust commission rates
  • Exclude shipping, taxes, discounts, or fees from commission calculations
  • Modify commission rules at any time

4. Refunds, Returns & Chargebacks

4.1 No commission is earned for:

  • Refunded orders
  • Returned products
  • Cancelled transactions
  • Chargebacks
  • Fraudulent or disputed payments

4.2 If a commission has already been recorded for an order that is later refunded, returned, cancelled, or charged back, such commission will be:

  • Rejected
  • Reversed
  • Deducted from future payouts

4.3 Commissions remain pending during the refund / return grace period and are only eligible for payout after successful completion of this period.

5. Prohibited Activities

Affiliates are strictly prohibited from engaging in any of the following:

5.1 Self-Purchases

  • Purchasing products through your own affiliate link
  • Using your affiliate link for personal, family, or household purchases

5.2 Fake, Fraudulent or Manipulated Traffic

  • Fake accounts, bots, click farms, automated traffic
  • Incentivized traffic that misleads users
  • Artificial conversions or test purchases

5.3 Coupon & Discount Abuse

  • Posting unauthorized coupon codes
  • Misrepresenting promotions
  • Using expired or misleading offers

5.4 Deceptive or Misleading Practices

  • False claims about products
  • Fake testimonials or reviews
  • Impersonation of Lumivique or its representatives

5.5 Brand & Trademark Violations

  • Bidding on brand keywords without written approval
  • Using brand names in domains, ads, or social handles deceptively

6. Compliance & Lawful Conduct

6.1 Affiliates must comply with:

  • All applicable laws and regulations
  • Advertising and consumer protection laws
  • The Federal Trade Commision (FTC) disclosure requirements or equivalent regulations in your jurisdiction

6.2 Affiliates must clearly disclose affiliate relationships where required by law.

7. Tracking, Reporting & Disputes

7.1 We rely on our tracking system as the sole and final authority for recording affiliate referrals and commissions.

7.2 We are not responsible for:

  • Tracking failures caused by browser settings, ad blockers, cookies deletion, or third-party interference
  • Lost commissions due to technical issues beyond our control

7.3 Any dispute regarding commissions must be submitted in writing within 30 days of the recorded transaction.

8. Payouts

8.1 Payouts are made only when:

  • The minimum payout threshold is met
  • All commissions are approved
  • No violations are detected

8.2 Payout schedules, methods, and thresholds are determined by us and may be changed at any time.

8.3 We reserves the right to withhold or delay payments for investigation of suspicious activity or compliance review.

9. Termination

9.1 Either party may terminate participation in the Program at any time.

9.2 Upon termination:

  • All unpaid commissions may be forfeited if earned through prohibited activities
  • Affiliate links and promotional rights must cease immediately

9.3 Termination does not limit our right to pursue legal remedies for violations or damages.

10. Limitation of Liability

10.1 Lumivique shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of revenue, profits, or business opportunities
  • Technical issues or system downtime

10.2 Our total liability under this Program shall not exceed the total commissions paid to you in the preceding 3 months.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lumivique, its owners, officers, employees, and partners from any claims, damages, losses, liabilities, or expenses arising from:

  • Your participation in the Program
  • Your violation of these Terms
  • Your unlawful or deceptive promotional activities

12. Modification of Terms

12.1 We reserve the right to modify these Terms at any time.

12.2 Continued participation in the Program after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles.
